市地税局、市财政局:
你们《关于改变我市国内单位土地增值税纳税地点的请示》(京地税二〔1998〕533号)收悉。现批复如下:
一、同意对本市范围内的国内单位土地增值税纳税地点进行调整,自1999年1月1日起,凡在本市转让在京房地产的国内单位,由向原房地产座落地的地方主管税务机关申报纳税,改为向转让项目的企业核算地或行政事业单位、社会团体税务注册登记地的地方主管税务机关申报纳
税。其他纳税人申报纳税仍按《北京市人民政府关于征收土地增值税有关政策问题的通知》(京政发〔1996〕7号)的有关规定执行。
二、本市国内单位土地增值税纳税地点调整后,原税款划分方式不变,每年年终通过市财政与区、县财政结算调整区、县税款交叉入库。纳税人应按规定自觉履行纳税义务;各级地方主管税务机关要认真做好有关工作,保证本市土地增值税征管工作的顺利进行。
第一条 为加强收费管理,规范收费行为,根据中共中央、国务院有关规定,制定本办法。
第二条 本办法适用于实施收费的国家机关、事业单位及非企业组织。
第三条 《收费许可证》由国务院价格主管部门负责统一制定样式,中央和省两级价格主管部门印制,各级价格主管部门分别核发。
第四条 《收费许可证》分正本和副本。正本用于收费单位悬挂,购买票据;副本用于亮证收费、年审及其它用途。
第五条 在京中央国家机关及其所属事业单位、非企业组织,凭合法有效的收费批准文件到国务院价格主管部门申领《收费许可证》;京外中央国家机关及其所属事业单位、非企业组织,凭合法有效的收费批准文件到省级价格主管部门申领《收费许可证》。省及省以下国家机关及其所
属事业单位、非企业组织《收费许可证》的具体核发办法由各省、自治区、直辖市人民政府价格主管部门会同同级财政部门制定,报国家发展计划委员会、财政部备案。
第六条 《收费许可证》实行一点一证。具有法人资格、财务独立核算、直接实施收费的单位为基本领证单位。有直接收费行为,但不具有法人资格、不实行财务独立核算的单位的收费点,由符合规定的领证单位统一申请办理《收费许可证》副本。
第七条 申领《收费许可证》按下列程序进行:
(一)申领单位到当地价格主管部门领取《收费许可证申请表》一式两份,按表列内容逐项填写并提供申请表所要求的资料;
(二)将填写好的申请表加盖本单位公章,负责人签名后送其上级主管部门确认,签署意见并加盖公章;
(三)价格主管部门对《收费许可证申请表》及批准收费的文件等进行审核,核准后颁发《收费许可证》。
《收费许可证申请表》由国务院价格主管部门统一样式,中央和省两级价格主管部门分别印制。
第八条 收费单位应于实施收费前20日申请核发《收费许可证》。
收费单位改变名称,增加收费项目、调整收费标准或收费范围,应于批准后20日内持批准文件到原发证机关办理《收费许可证》变更手续。
收费单位合并、分立、迁移或停业时,应于批准后20日内持批准文件到原发证机关办理《收费许可证》变更或注销手续。
收费单位丢失、损坏《收费许可证》时,应公告作废并及时到原发证机关申请补发新证。
第九条 收费单位申领《收费许可证》时,须提供下列资料:
(一)合法有效的批准收费的文件;
(二)法人资格证明或机构编制及经费来源情况的文件;
(三)政府或业务主管部门批准执业的文件;
(四)其它相关资料。
第十条 《收费许可证》有效期3年。
对临时性、一次性收费可核发临时收费许可证,并依实施收费情况注明有效期限,但最长不得超过1年。临时收费许可证发放的具体办法由各省、自治区、直辖市人民政府价格主管部门会同同级财政部门制定。
第十一条 《收费许可证》是收费单位依法收费的凭证。各收费单位要做到亮证收费,自觉接受价格、财政主管部门和社会各界的监督。
第十二条 价格主管部门要按照国家有关规定,严格办证手续,按照批准的收费项目和收费标准,详细填写《收费许可证》,并建立《收费许可证》管理档案。
第十三条 价格主管部门对经过审查符合本办法规定的收费单位,应在收到《收费许可证申请表》后15日之内核准发证;对不符合规定的收费亦应于收到《收费许可证申请表》后15日内通知申领单位不得收费并说明理由。
第十四条 《收费许可证》实行审验制度。经审验合格的,由发证机关加盖年度审验章后方可继续使用。
《收费许可证》审验内容包括:
(一)《收费许可证》中填列的单位、收费项目、收费标准、收费范围、收费对象、计算单位等与实际执行是否一致;
(二)是否继续保留该项收费或维持原有的收费标准;
(三)有无违法记录。
审验中发现有违反国家收费管理规定的,由价格主管部门依法处理。
第十五条 下级价格主管和部门核发《收费许可证》不符合国家有关政策规定的,上级价格主管部门可责令其改正。
第十六条 价格、财政主管部门负责对收费单位的《收费许可证》制度执行情况进行监督检查。各收费单位必须向价格、财政主管部门如实提供有关资料,自觉接受监督检查。
收费单位有违反收费管理规定的乱收费行为,由价格、财政主管部门根据国家有关规定查处。
第十七条 收费单位有涂改、转借《收费许可证》行为的,价格主管部门可暂扣或吊销其《收费许可证》。
第十八条 《收费许可证》工本费标准由省级以上人民政府价格主管部门报同级财政部门核定后执行。
第十九条 自本法实施之日起3个月内,原发旧证废止,收费单位须按本办法规定的条件和程序重新换领新证。
第二十条 本办法自1999年1月1日起施行。

第一章 总 则
第一条 为了加强城市市政设施管理,保障市政设施完好,充分发挥市政设施使用功能,促进城市经济和社会发展,根据有关法律、法规的规定,结合本市实际,制定本办法。
第二条 本办法适用于本市城市规划区内城市道路、桥涵、排水、照明等市政设施的建设、养护、维修和管理。
第三条 本办法所称的市政设施是指:
(一)城市道路的干道、支道、小街小巷、人行道、公共广场、公共停车场、路肩及其附属设施;
(二)城市桥梁、涵洞、立体交叉桥、人行天桥、地下通道及其附属设施;
(三)城市雨水管道、污水管道、雨污合流管道、明渠、暗渠、排水大沟、泵站、污水处理设施以及积沙井、检查井及其附属设施;
(四)城市道路、桥梁、人行天桥、地下通道、广场、公共绿地(不含公园和收费娱乐场所)等处的照明设施及其附属设施。
本条前款第二、四项所称“地下通道”,不包括兼作地下通道的人防工程。
第四条 本市市政设施实行管养并重,协调发展,有偿使用,统一管理与分级负责相结合的原则。
第五条 市政设施建设必须纳入国民经济社会发展计划和城市总体规划。
市政设施的规划、设计和施工,必须符合国家和本省、市规定的技术规范和标准。
第六条 市、区、县(市)人民政府应当保证市政设施养护、维修经费投入,鼓励和支持市政设施科学技术研究,推广应用先进技术,提高市政设施养护、维修的机械化水平,提高市政设施管理的科学技术水平。
第七条 鼓励社会各界按照市政设施发展规划,投资市政设施建设,投资者的合法权益受法律保护。
第八条 贵阳市人民政府市政设施主管部门,主管本市市政设施管理工作。
贵阳市人民政府市政设施主管部门在其法定权限内可以委托符合条件的市政设施管理部门实施行政处罚。
城区市政设施管理部门按照市人民政府规定的管理职责,负责所辖区域内的市政设施的养护、维修和管理工作。
乌当区、花溪区、白云区、清镇市、修文县、息烽县、开阳县人民政府市政设施管理部门按照市人民政府规定的管理职责,主管所辖区域内的市政设施的养护、维修和管理工作。
规划、建设、公安、工商等部门应当按照各自职责分工,协同做好市政设施的管理工作。
第九条 禁止盗窃、损毁、破坏市政设施的行为。
任何单位和个人都有爱护市政设施的义务,并有对违反本办法的行为进行制止、检举和控告的权利。
对维护市政设施做出显著成绩的单位和个人,由市、区、县(市)人民政府或者市政设施主管部门给予表彰、奖励。
第二章 一般规定
第十条 以市政设施为载体建设的各类管线、构筑物,应当与市政设施统一规划、同步建设。
市政设施主管部门应当参加市政设施建设竣工验收。
未经验收或者验收不合格的市政设施,市政设施管理部门不得接收管养。
第十一条 市政设施管理部门应当加强对市政设施的养护、维修和管理。经常巡视检查,及时养护维修,严格控制对道路的占用和挖掘,合理使用其他市政设施,保障其功能完好和正常运行。
市政设施的养护、维修,应当严格遵守有关技术规范和标准,按照规定期限完工,确保工程质量,并接受市政设施主管部门的监督检查。
市政设施管理部门应当建立养护、维修与管理相分离的内部工作制度,建立养护、维修责任制,完善监督制约机制。
第十二条 市政设施管理部门应当定期组织对所管理的市政设施进行检测和普查,并编制养护、维修计划,报同级人民政府核定养护、维修经费。
市政设施发生故障和险情,市政设施管理部门或者产权单位应当及时组织抢修、排险,尽快恢复正常使用。
第十三条 未经批准,任何单位和个人不得改动、拆除、迁移市政设施或者改变其使用性质。经批准改动、拆除、迁移市政设施的,改动、拆迁单位应当承担改动、拆除、迁移的费用。
第十四条 非政府部门投资建设的市政设施,由产权单位按照本办法的规定,负责养护、维修,确保该市政设施完好、安全,并接受市政设施管理部门的监督、检查。
第十五条 市政设施管理实行公开办事制度和投诉受理制度,公开办事程序和办事结果,认真接受和处理投诉,接受社会监督。
市政设施管理执法人员实施行政处罚,应当出示合法、有效的行政执法证件,说明理由和法律依据。
市政设施管理部门对占用、改动、拆除、迁移、接用市政设施的申请,应当在符合法律、法规和本办法规定条件后的15日内办理完毕;受理投诉,应当自受理之日起15日内处理完毕,情况复杂的,不得超过30日。
第十六条 市政设施的养护、维修作业现场,必须设置明显标志和安全防护设施。施工专用车辆应当使用统一标志;执行任务时,在保证交通安全畅通的前提下,可以不受行驶路线和行驶方向的限制。
第三章 城市道路、桥涵管理
第十七条 城市道路、桥涵范围内禁止下列行为:
(一)擅自挖掘道路、桥涵设施,修筑出入道口,设置路障;
(二)擅自占用城市道路、桥涵摆摊设点、停放车辆、堆放物料、施工作业、搭建建筑物和构筑物、进行集市贸易;
(三)擅自在城市道路、桥涵上行驶履带车、铁轮车及超重、超高、超长车辆;
(四)机动车在非指定道路、桥涵上试刹车,在人行道上行驶,车辆载物拖刮路面;
(五)在桥梁上架设压力在4千克/平方厘米(0.4兆帕)以上的煤气管道、10千伏以上的高压电力线和其他易燃易爆管线;
(六)倾倒垃圾、排放污水、冲洗车辆;
(七)擅自在道路、桥涵设施上设置广告或者其他悬挂物;
(八)焚烧杂物、晾晒碾打农作物、挖砂取土、拌和混凝土和水泥砂浆、冲洗砂石等有损道路、桥涵设施的各种作业;
(九)擅自挪动井盖等附属设施;
(十)利用道路、桥涵设施进行围栏、吊装、牵引等施工作业;
(十一)损害、侵占道路、桥涵设施的其他行为。
第十八条 因特殊情况,确需临时占用城市道路的,必须经市政设施管理部门和公安交通管理部门批准,向市政设施管理部门缴纳城市道路占用费,由市政设施管理部门发放占道许可证后,方可占用。
临时占用城市道路期满需继续占用的,应当在期满前办理延期审批手续,经批准后方可继续占用。
市政设施管理部门或者公安交通管理部门根据城市建设或者交通管理的需要,对经批准临时占用城市道路的单位和个人,可以决定缩小占用面积、缩短占用时间或者停止占用,市政设施管理部门应当按照实际占用道路的情况,退还部分城市道路占用费。
第十九条 经批准临时占用城市道路的单位和个人,应当遵守下列规定:
(一)将占道许可证悬挂在占道范围内的醒目处;
(二)按照批准的期限、范围和用途占用,不得转让、出租;
(三)建筑施工必须采取安全措施,文明施工,并且按照规定修筑临时围栏;
(四)占用期满及时清除占道物资,恢复城市道路原状,并且在48小时内通知市政设施管理部门验收。
第二十条 严格控制占用城市道路作为集贸市场或者停车场(点)。确需临时占用城市道路作为集贸市场或者停车场(点)的,应当经市、县人民政府批准,按照本办法规定办理占道许可证和缴纳城市道路占用费,并且由集贸市场和停车场(点)的收费单位负责养护、维修;未经批准,擅自占用城市道路作为集贸市场或者停车场(点)的,市政设施管理部门应当责令限期清退,恢复城市功能。
《城市道路管理条例》实施前未经县级以上人民政府批准占用城市道路作为集贸市场或者停车场(点)的,应当制定计划,逐步清退,或者按照本办法规定重新办理审批手续。
第二十一条 因工程建设需要挖掘城市道路的,必须经市政设施管理部门和公安交通管理部门批准,向市政设施管理部门缴纳城市道路挖掘修复费,由市政设施管理部门发放挖掘许可证后,方可挖掘。
单位或者个人需要在城市道路上修建车辆出入道口的,按照本条前款规定办理。
地下管线发生故障需要紧急抢修的,抢修单位可以先行破路抢修,同时通知市政设施管理部门和公安交通管理部门,在24小时内按照规定补办掘路手续,补缴城市道路挖掘修复费。
第二十二条 纳入城市新建和维修计划的市政工程的占、掘道,按照本办法规定办理手续,在批准占、掘期内免交占、掘费,超过期限按照规定缴费。市政设施管理部门维修道路,需要占、掘道路,除日常维修养护道路作业外,必须与公安交通管理部门协商,共同采取维护交通的措施后,再行施工。
第二十三条 新建、改建、扩建的城市道路交付使用后5年内、大修的城市道路竣工后3年内不得挖掘;因特殊情况需要提前挖掘的,必须经市、区、县(市)人民政府批准,按照本办法第二十一条的规定办理审批手续,并缴纳3倍的挖掘修复费。挖掘路面是水泥混凝土的,缴纳5倍的挖掘修复费。
第二十四条 经批准挖掘城市道路的单位和个人,应当遵守下列规定:
(一)按照批准的位置、面积和期限挖掘;
(二)施工现场应当悬挂挖掘许可证,设置明显标志和安全防围设施,文明施工;
(三)横向挖掘城市道路铺设地下管线的,应当顶管施工;不能顶管施工的,应当按照路宽分半施工,保证车辆通行;
(四)涉及地下管线设备、测量标志、消防栓、架空杆线、排水管沟、人防工程、文物古迹以及其他地下、地上设施等,掘路单位和个人应当联系有关单位协同配合,妥为保护;
(五)不得回填混入垃圾的泥土及其他杂物,回填砂石料应当夯实,保证工程质量;
(六)施工完毕,及时清运施工作业弃置的物料和垃圾等,保持市容整洁,并在48小时内通知市政设施管理部门检查验收。
第二十五条 使用城市道路、桥涵及附属设施设置广告牌、招贴牌的,必须持有关部门批准文件,到市政设施管理部门办理审批手续。
第二十六条 履带车、铁轮车或者超重、超高、超长车辆确需通过城市道路和桥涵的,应当经市政设施管理部门同意,采取必要的保护措施后,按照公安交通管理部门指定的时间、路线行驶。因采取保护措施所需的费用,由使用车辆的单位或者个人承担。
军用车辆执行任务需要在城市道路、桥涵上行驶的,可以不受前款限制,但是应当按照规定采取安全保护措施。
第二十七条 因特殊情况确需在城市桥涵保护区域内从事打桩、顶进、架设管道设施的单位和个人,在取得施工许可证前应当经市政设施管理部门同意,采取保护措施后方可施工。
第二十八条 道路、桥涵发生损坏影响通行安全时,市政设施管理部门和公安交通管理部门,应当立即采取有效的交通安全措施。
第四章 城市排水设施管理
第二十九条 禁止对城市排水设施实施下列行为:
(一)擅自在排水大沟两侧3米保护范围内及其附属设施上修建建筑物、构筑物,堆放重物,停放重车;
(二)擅自圈占、覆盖、拆除、改建、堵塞、损坏城市排水大沟、下水道、排水泵站、污水处理等排水设施;
(三)擅自揭开和挪动检查井、积沙井的井盖;
(四)向排水设施倾倒垃圾、废渣、泥土和其他杂物;
(五)向排水设施排放或者洒漏腐蚀性、放射性、易燃、易爆等有毒有害物品;
(六)私接下水道;
(七)其他可能影响排水设施的行为。
第三十条 新建、改建、扩建或者整修、迁移专用下水道,必须遵守下列规定:
(一)建设单位或者个人需使用城市公用排水管渠,新增排水的,应当向市政设施管理部门申请,并提供有关设计文件、施工图纸、排水的水量、水质、废水治理等资料,经审查同意后,按照批准位置和技术要求与城市公用排水管渠相接,由市政设施管理部门验收,其工程费用由建设单位或者个人承担;
(二)任何单位或者个人需将新建下水道接入其他单位专用下水道和处理设施的,应当与产权单位协商,并且报市政设施管理部门审查同意。确因城市建设需要,产权单位应当服从市政设施管理部门安排;
(三)在雨污分流系统上接入排水管道时,任何单位和个人不得造成雨污混流。
第三十一条 有毒、有害、含有易燃易爆物质的污水,必须经过净化处理,达到排放标准,经环保部门批准后,方可排入城市下水道。
第三十二条 城市排水设施发生故障或者险情需要停止排放、抢修、排险时,有关排水用户应当按照市政设施管理部门的要求,采取措施,配合抢修、排险。
第三十三条 新设的地下管线与现有排水设施平面相交时,不得破截排水管渠。
经城市规划管理部门批准修建的临时建筑,应当按照规定要求排水。
第五章 城市照明设施管理
第三十四条 在城市照明设施及其相关范围内禁止下列行为:
(一)擅自拆除、迁移、改动照明设施;
(二)擅自接用、切断照明线路;
(三)擅自在照明设施上架设、安装、悬挂、张贴广告、标牌、灯箱、条幅等以及其他非道路照明使用的线路和设施;
(四)在照明设施周围3米内搭棚围栏、堆放杂物、挖坑取土、建造建筑物、倾倒废渣、废水和使用明火作业;
(五)其他有损照明设施运行的行为。
第三十五条 确因工程建设等特殊原因需要改动、拆除、迁移照明设施或者接用、切断道路照明电源的,必须经市政设施管理部门批准,办理有关手续后,由市政照明设施管理单位实施,费用由申报单位承担。
使用路灯电杆架设与道路照明无关的线路,张贴、悬挂、设置广告和宣传品等,必须持有关部门批准文件,到市政设施管理部门办理审批手续。
第三十六条 道路照明设施带电物体距附近的树木的安全距离不得小于1米。因自然生长不符合安全距离标准、影响照明效果或者妨碍道路照明设施维修的树木,园林绿化管理部门应当及时组织修剪。
第六章 法律责任
第三十七条 越权审批占用、挖掘市政设施,其批文无效,对直接责任人员给予行政处分;造成损失的,依法承担赔偿责任。
第三十八条 违反本办法第十条第三款规定的,责令限期改正,给予警告,并可处以工程造价2%以下罚款。
第三十九条 违反本办法第十九条第一项、第二十四条第二、六项规定的,责令限期改正;逾期不改的,处以200元以上500元以下罚款。
违反本办法第十九条第二、三、四项,第二十四条第一、三项,第三十条第二项规定的,处以500元以上2000元以下罚款。
违反本办法第二十四条第五项和第三十条第一、三项规定的,处以2000元以上5000元以下罚款。造成损失的,应当依法承担赔偿责任。
第四十条 违反本办法的其他行为,按照下列规定处理:
(一)未造成设施损毁的,责令改正,可以对责任者处以50元以上100元以下罚款;
(二)造成设施损坏,尚不影响使用的,责令修复或者赔偿损失,对责任者处以100元以上1000元以下罚款;
(三)造成设施损毁,影响正常使用的,责令修复或者赔偿损失,对责任者处以100元以上1万元以下罚款;
(四)违反本办法占、掘道路的,责令限期拆除、修复并且赔偿损失,并且按照城市道路占用费、挖掘修复费标准处以5倍至10倍的罚款。
本条前款第四项所处的罚款,最高金额不得超过2万元。
第四十一条 违反本办法规定,擅自占用、挖掘城市道路、桥涵,违章使用其他市政设施,又不能当场处理的,市政设施管理部门可以暂扣工具。
暂扣工具,执法人员应当开具凭据和清单。
第四十二条 承担市政设施养护、维修的单位,未按照技术规范和标准、未定期对市政设施进行养护、维修或者未按期保质修复竣工,拒绝接受监督、检查的,责令限期改正,给予警告;对负有直接责任的主管人员和其他直接责任人员,给予行政处分。
第四十三条 市政设施管理工作人员玩忽职守、滥用职权、徇私舞弊的,由其所在单位或者上级主管机关给予行政处分;造成损失的,依法承担赔偿责任。
第七章 附则
第四十四条 本办法自公布之日起施行。本市过去发布的有关市政工程设施管理办法同时废止。

A bill of exchange is an unconditional order in writing, addressed
by
person to another, signed by the person giving it,
requiring the

Bill payable at future time
A bill is payable at a determinable future time within the meaning
of
Ordinance which is expressed to be payable--
at a fixed period after date or sight;
on or at a fixed period after the occurrence of a specified

uncertain.
An instrument expressed to be payable on a contingency is not a
bill,
the happening of the event does not cure the defect.

Definition and requisites of acceptance
The acceptance of a bill is the signification by the drawee of

An acceptance is invalid unless it complies with the

words, is

it must not express that the drawee will perform his promise by

Time for acceptance
A bill may be accepted--
before it has been signed by the drawer, or while
otherwise
mplete;
when it is overdue, or after it has been dishonoured by a
ious refusal to accept or by non-payment.
When a bill payable after sight is dishonoured by non-acceptance,
and
drawee subsequently accepts it, the holder, in the absence
of any
erent agreement, is entitled to have the bill accepted as of the
date

General and qualified acceptance
An acceptance is either (a) general; or (b) qualified.
A general acceptance assents without qualification to the order
of the
er. A qualified acceptance in express terms varies the effect of
the
as drawn.
In particular, an acceptance is qualified which is--
conditional, that is to say, which makes payment by the
acceptor
ndent on the fulfilment of a condition therein stated,
partial, that is to say, an acceptance to pay part only of the
amount
which the bill is drawn;
local, that is to say, an acceptance to pay only at a
particular
ified place; an acceptance to pay at a particular place is a
general
ptance, unless it expressly states that the bill is to be paid
there
and not elsewhere;
qualified as to time;
the acceptance of some one or more of the drawees, but not of all.

Inchoate instruments
Where a simple signature on a blank paper is delivered by the
signer
rder that it may be converted into a bill, it operates as a
prima
e authority to fill it up as a complete bill for any amount, using
the
ature for that of the drawer, or the acceptor, or an indorser;
and, in
manner, when a bill is wanting in any material particular, the
person
ossession of it has a prima facie authority to fill up the omission
in

In order that any such instrument, when completed, may be
enforceable
nst any person who became a party thereto prior to its completion,
